Bombay High Court Orders Removal of Salman Khan’s Name from Petition in Anuj Thapan Case
The Bombay High Court has ruled that actor Salman Khan’s name must be removed from a petition seeking a CBI probe into the alleged custodial death of Anuj Thapan. Anuj, who was accused of supplying weapons in a case involving a shooting incident outside Salman Khan’s residence, was found dead in a police lock-up toilet on May 1. His mother, Rita Devi, filed the petition on May 3, alleging foul play and requesting a CBI investigation into her son’s death.
Court’s Decision: Salman Khan Not a Necessary Party
A division bench consisting of Justices Revati Mohite-Dere and Shyam Chandak directed Ms. Devi to exclude Salman Khan from the petition. The court clarified that the petition did not seek any relief from Salman Khan and contained no allegations against him. “He is not a necessary party,” the bench stated, emphasizing that Ms. Devi’s primary concern is the investigation into her son’s death, which will continue without involving the actor.
Legal Arguments and Court’s Stance
Ms. Devi’s lawyer argued that although no specific relief was sought from Salman Khan, he should still be included in the ongoing CID probe. The court, however, responded that the decision to include individuals in the investigation rests with the CID, advising the lawyer to concentrate on the core issue—Anuj Thapan’s death—without unnecessary digressions.
Background of the Case
On April 14, two shooters opened fire outside Salman Khan’s residence and were later apprehended. Anuj Thapan was arrested in Punjab on April 26, accused of supplying weapons to the shooters. His death in custody on May 1 raised suspicions of police brutality, prompting his mother to seek justice through legal channels.
Next Steps in the Investigation
The court has directed the magistrate to issue a fresh summons to Ms. Devi to record her statement. The CID investigation into Anuj Thapan’s death is ongoing, focusing on the circumstances leading to his demise in custody.
