Can Jailed Leader Amritpal Singh Function as MP After Lok Sabha Victory?

 

7 June 2024, Chandigarh, Amritpal Singh, currently incarcerated under the National Security Act (NSA) in Assam’s Dibrugarh jail, faces a critical question following his Lok Sabha victory: can he function as an MP while being an undertrial? Arrested by the Punjab Police from Moga’s Rode village last April after a month-long manhunt, Amritpal Singh is charged under the NSA, a preventive detention law allowing up to 12 months of detention without formal charges. He faces eleven criminal cases in Punjab and one in Dibrugarh for unauthorized use of electronic gadgets in prison.

 

Parliamentary Procedures for MPs Taking Oath

Under Article 99 of the Constitution, every member of Parliament (MP) must take an oath before the President to commence their duties. There have been precedents where incarcerated lawmakers were granted custody parole or interim bail to fulfill their parliamentary obligations. For example, in March, Aam Aadmi Party (AAP) leader Sanjay Singh, imprisoned on money laundering charges, was permitted by a Delhi Court to take his oath as a Rajya Sabha member.

 

Judicial Intervention Required

 

To be sworn in as an MP, Amritpal Singh will need to seek judicial intervention. Courts can grant him temporary bail or custody parole to attend the oath-taking ceremony. Post-ceremony, he will return to jail. Depending on the duration of the parole or interim bail, Amritpal Singh must notify the Speaker in writing if he will be unable to attend House proceedings due to his incarceration. 

 

Implications of Prolonged Absence

 

Article 101(4) of the Constitution stipulates that if an MP is absent from all meetings for 60 days without the House’s permission, their seat may be declared vacant. The Speaker would refer such requests to the House Committee on Absence of Members, whose recommendation will be put to a vote in the House.

 

Potential Conviction and Disqualification 

 

If Amritpal Singh is eventually convicted, he will immediately lose his Lok Sabha seat under Section 8(3) of the Representation of People Act, 1951 (RPA), which mandates the disqualification of MPs sentenced to imprisonment for not less than two years. This would also bar Amritpal Singh from contesting elections for six years post-release, and his seat would be declared vacant, necessitating by-polls.

Amritpal Singh’s ability to function as an MP while incarcerated hinges on judicial decisions regarding temporary bail or parole. The legal and constitutional provisions in place will dictate his participation in parliamentary duties and his continuation as an MP, contingent on the outcomes of his ongoing legal battles.
